- Introduction and Scope
These Terms & Conditions (the “Terms”) govern your use of the website https://expressbooking.ch (the “Portal”) and all services provided through it by Zwiss GmbH, the company legally responsible for operating the Portal.
By using the Portal, submitting an enquiry or booking, or otherwise engaging our services, you expressly agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our services.
- Definitions
Customer means you, the user accessing the Portal to make enquiries or bookings.
Provider means an independent third-party supplier offering a service, such as tours, events, transport, or accommodation.
Brokerage Services refers to the tools, systems, and support offered by Zwiss GmbH through expressbooking.ch to facilitate bookings between you and Providers.
Service Details means the information about a service, including description, pricing, inclusions, schedule, and terms, as provided to you via the Portal.
Booking Confirmation means the communication from Zwiss GmbH (operator of expressbooking.ch) to the Customer stating the acceptance of a booking request.
- Zwiss GmbH’s Role and Intermediary Status
Zwiss GmbH, operating the portal expressbooking.ch, acts solely as a broker or intermediary between you and Providers.
The actual contract for the provision of the service is always between you and the Provider. Zwiss GmbH facilitates communication, booking requests, and payment processing via certified partners Datatrans Ltd and its acquiring/processing partner Worldline Switzerland AG.
Unless explicitly indicated on the Portal, Zwiss GmbH does not operate as a tour operator, travel agent, or principal provider of services.
- Account Registration and Eligibility
To make bookings, you may need to create an account. You warrant that:
- You are at least 18 years old and legally capable of contracting.
- The information you provide is complete, accurate, and kept current.
- You are responsible for securing your login credentials and for all activity under your account.
- You will notify Zwiss GmbH promptly of any unauthorized use or security breach.
- Booking Process and Contract Formation
- Initiating a booking on the Portal constitutes an offer to purchase a Provider’s service.
- You will receive an acknowledgement email after submission—this does not yet constitute acceptance.
- A binding contract is formed only when you receive a Booking Confirmation.
- Until acceptance, pricing, availability, or terms may change or be withdrawn.
- Zwiss GmbH reserves the right to decline or cancel bookings at its discretion, including high-risk or fraudulent requests.
- Pricing, Service Fees, and Taxes
- All prices are displayed in Swiss Francs (CHF) unless stated otherwise.
- Pricing may exclude local taxes, surcharges, or fees collected by Providers onsite.
- Zwiss GmbH may add a separate service or processing fee, which will be clearly displayed at checkout.
- Currency conversion rates are indicative only; actual rates and fees may be imposed by your payment provider.
- Payment Authorization, Processing, and Fraud Prevention
- All payments made through the Portal are processed exclusively via Datatrans Ltd and its acquiring/processing partner Worldline Switzerland AG, both PCI-DSS-certified payment service providers.
- Zwiss GmbH does not store or directly process your full payment card details.
- You authorise Zwiss GmbH, Datatrans Ltd, and Worldline Switzerland AG to process your payment information as necessary to complete your transaction.
- Zwiss GmbH, Datatrans Ltd, and Worldline may request additional verification documentation or refuse transactions that appear suspicious, unauthorized, or fraudulent.
- Chargebacks or disputes must only be initiated after contacting our support team to attempt resolution. Unjustified or premature chargebacks may result in account suspension or legal action.
- Cancellations, Modifications, Refunds, and No-Shows
8.1 Customer-Initiated Cancellations
- You may cancel your confirmed booking free of charge up to 24 hours before the scheduled service start time (local time of the Provider).
- Refunds for eligible cancellations will be processed within 3 business days via Datatrans AG and Worldline Switzerland AG to the original payment method used.
- Cancellations made less than 24 hours before the event may be non-refundable, unless otherwise stated in the service-specific terms.
8.2 Provider-Initiated Cancellations
- Providers may cancel their services due to operational reasons, weather, safety concerns, force majeure, or low participation.
- In such cases, Zwiss GmbH will promptly notify you, and you will be offered either a full refund or the option to reschedule at no additional cost.
8.3 Modifications
- You may request date/time or participant changes up to 24 hours before the scheduled start.
- Modifications are subject to availability and may incur additional charges.
- If the Provider cannot accommodate the change, the original booking remains in effect and standard cancellation policies apply.
8.4 No-Shows
- If you fail to arrive on time for a scheduled service without prior cancellation, the Provider may treat it as a no-show, and the booking will become non-refundable.
8.5 Partial Delivery / Interruptions
- If a service is partially delivered or interrupted (e.g., due to weather or safety), refunds or partial refunds are governed by the Provider’s terms. Zwiss GmbH will assist in good faith.
- Changes by Providers
Providers may alter route, schedule, inclusions, duration, or other service elements due to safety, weather, equipment, staffing, or regulatory changes. Such alterations are not a breach by Zwiss GmbH, and we will assist in resolving issues or providing alternatives where feasible.
- Liability and Disclaimer
- Zwiss GmbH serves solely as an intermediary. Responsibility for the actual performance of the service lies with the Provider.
- Zwiss GmbH disclaims all liability for Provider omissions or failures, including personal injury, property loss, or scheduling conflicts.
- Zwiss GmbH does not warrant the accuracy, completeness, or suitability of Service Details.
- Zwiss GmbH is not liable for indirect, incidental, special, or consequential damages (e.g., lost profits, loss of business, loss of data), to the fullest extent permitted by law.
- Our maximum aggregate liability arising from use of the Portal or services is limited to the greater of CHF 1,000 or the service fees you paid to Zwiss GmbH in the preceding 12 months. This does not apply to liability for gross negligence, intent, or mandatory consumer protections.
- Payment Systems Disclaimer: Zwiss GmbH is not responsible for disruptions, delays, or errors caused by third-party payment systems including Datatrans Ltd and Worldline Switzerland AG, nor for failures of card networks, issuing banks, or other financial institutions.
- Zwiss GmbH is also not responsible for disruptions due to website hosting, Cloudflare services, or force majeure events including but not limited to natural disasters, strikes, civil unrest, pandemics, or governmental measures.
- You agree to indemnify and hold Zwiss GmbH harmless from third-party claims arising from your breach of these Terms, misuse of the Portal, or violation of law or Provider rules.
- Intellectual Property Rights
All intellectual property, including but not limited to text, graphics, logos, software, data compilations, and images on the Portal, is owned by Zwiss GmbH or licensed partners. Any unauthorized use, reproduction, or distribution is strictly prohibited.
- User-Generated Reviews and Content
If you provide reviews or upload media (e.g., photos, comments), you grant Zwiss GmbH a worldwide, perpetual, royalty-free license to use such content for marketing and promotional purposes. Zwiss GmbH will not identify you publicly without your consent; please do not include personal or sensitive information in your submissions.
- Privacy & Data Protection
The processing of your personal data is governed by our Privacy & Cookie Policy, available at https://expressbooking.ch/privacy-cookie-policy. Please refer to it for details on how we collect, use, and protect your data, and your rights concerning that data.
- Governing Law and Jurisdiction
These Terms are governed by Swiss law, excluding its conflict-of-laws rules. Exclusive jurisdiction is with the competent courts at the registered seat of Zwiss GmbH. Mandatory provisions of consumer protection law remain unaffected.
- Modifications to These Terms
Zwiss GmbH reserves the right to amend these Terms at any time. The version posted on the Portal at the time of your booking or service use is the applicable version. Continued use of the Portal or services after an update constitutes your acceptance.
